Dear JonIt is with love and outrage that we are writing to inform you that the Supreme Court of Canada has declined to hear the Tsleil-Waututh, Squamish and Coldwater case against Trans Mountain. Squamish, Tsleil Waututh and Coldwater First Nations have worked for eight long years to assert their rights to be consulted on the Trans Mountain pipeline and tankers expansion project. It is incredibly disappointing that Canada’s top court has denied them an opportunity to be heard on a recent Court of Appeal decision upholding Trans Mountain’s approval - a decision that has potentially disastrous consequences specifically for these Nations. This denial also sets an adverse precedent in terms of rights to consultation for all First Nations, Inuit and Métis peoples in Canada. This is one of the most important cases of the decade. The recent oil spill along the Trans Mountain pipeline route at the Sumas pump stations signals the environmental risks posed by transporting tar sands bitumen over land and water. But the risk to human rights and progress on putting fuzzy notions of ‘reconciliation’ into meaningful action is graver still. Since committing to honour the Free, Prior and Informed Consent of Indigenous Nations, the Canadian government has done little to nothing to meaningfully recognize the rights of First Nations. This latest Supreme Court denial underscores the discrepancy between talk and action when it comes to what the BC government once claimed was its most important relationship. We will never give up on our struggle to defend rights and protect the Earth. We cannot wait to be alongside you as we continue to protect the lands, air, and waters from tar sands pipeline and tanker expansion. Dear JonWhen we launched our Pull Together campaign with Sierra Club BC four years ago, thousands of people stood up and pledged to do ‘whatever it takes’ to support Indigenous Nations in their legal challenges against the pipeline. As you likely know, on July 2nd Squamish Nation, Tsleil-Waututh Nation and Coldwater Indian Band were denied leave to appeal by the Supreme Court of Canada. While this represents the end of the road for the particular legal challenges you have been backing, the fight is by no means over. Read about what the decision means for Indigenous rights in Canada, and watch the press conference to hear how First Nations are not backing down. RAVEN supporters like you have showed up, again and again, with fantastically creative fundraisers and generous donations: you have put the ‘solid’ in solidarity. From pancake breakfasts to drag shows to epic Salish Sea swims, paddles and sails - people, businesses, and community groups found ways to use their strengths to bolster the Nations in an epic struggle to defend what we all love so dearly. To keep these cherished alliances going strong, we are joining together with BROKE - Burnaby Residents Opposed to Kinder Morgan Expansion - to host a virtual Folk Festival! Today, hereditary chiefs who aim to stop Coastal GasLink from encroaching on their territory will be in court for the second - and final - day of their Judicial Review hearing. These visionary stewards of land and water are refusing to allow their territory to be defiled by a company that has consistently failed to live up to environmental and human rights standards. Under normal circumstances, we would invite you to gather together and rally on the courthouse steps. Instead, we reached out to you using the online tools we now rely on to keep our movement - and the RAVEN community - connected. And: wow!! You responded with a roar. Jon, your overwhelming support for Wet’suwet’en Nation this week has proven that we don’t need to physically connect to make a massive impact. We also heard about steps Indigenous Nations are taking to defend their rights. Although the Supreme Court’s decision marked the end of one legal road, we learned how Coldwater Nation is stepping up in defence of their drinking water. Even though one of the conditions of the Trans Mountain pipeline approval requires measures be taken to protect the community’s water supply, 4 years later Coldwater is still waiting for TMX to deliver on a government-mandated study of the Nation’s aquifer.
If Coldwater’s latest submission is accepted by Canada’s energy regulator, TMX will be forced to stop construction, causing months of delay. If, however, Canada allows the project to proceed without meeting its own conditions, Coldwater has promised to take legal action. Stay tuned: visit our website for the full story. We are in this for the long haul. We’ve seen big wins across Turtle Island, as three major pipelines were halted: Keystone XL, Dakota Access and Atlantic Coast. Indigenous Nations along the TMX pipeline route have declared that they will never give up. Neither will we. When we join together with creativity, joy and sweet solidarity: we are a force of nature.

Indigenous People’s most hard-fought Constitutional protection could lose its meaning. No images? Click here Dear Jon,On the west coast of North America, massive wildfires have blocked the sun. Amidst floods on the Gulf Coast and record breaking temperatures in the Arctic, the pressures of a changing climate are being felt across Turtle Island. Today, a courageous Indigenous Nation is facing down that climate calamity with determined action. The Beaver Lake Cree are heading back to court, fighting to hold on to their advance costs award so they can pursue their groundbreaking case, the Tar Sands Trial. The Nation needs $40,000 to pursue this appeal: if you are in a position to give, now is the time. Last fall, the RAVEN community empowered Beaver Lake Cree Nation with the resources to pursue — and win — a partial advance costs award for a case that was ruled to be of national importance. Outrageously, Canada and Alberta appealed, and in June the award decision was overturned by the Alberta Court of Appeal. The Court ruled that the Beaver Lake Cree government must exhaust all available resources before they can qualify for any amount of advance costs. Essentially: the BLCN government must bankrupt itself in order to defend its treaty and constitutional rights. Jon, this precedent cannot stand. The decision to revoke funding for Beaver Lake Cree essentially closes the door for other Nations to receive advance costs awards to pursue justice. It is a setback to reconciliation: that’s why the Beaver Lake Cree are filing an appeal to the Supreme Court of Canada. According to Beaver Lake Cree’s Government Relations Adviser & Treaty Coordinator Crystal Lameman, “The Alberta Court of Appeal has so severely narrowed the criteria for financial need that it will be impossible for most First Nations to obtain an advance cost order.” In the ruling, the Alberta Court of Appeal found that if Nations were recipients of federal funding, proven in multiple reports to be woefully inadequate — including the type of critical funding that is afforded any municipality in the country for roads, infrastructure, and health care — they would be disqualified from receiving advance costs. The costly demands placed on First Nations to vindicate their constitutional rights in court clash with a painful reality – First Nations are amongst the poorest people in Canada. Amidst that poverty, their governments are responsible for ensuring their communities endure and thrive over many generations. Yet a community cannot survive if its members are destitute or lands spoiled. If this decision is not challenged, Nations that struggle to meet their communities’ basic needs - such as providing for water, housing, and a healthy ecosystem - will have no option to receive advance costs awards to pursue their legal rights. People power has kept the Tar Sands Trial alive through nearly a decade of government’s delay tactics. It’s energizing to reflect on our past successes, so that we can once again muster our forces to deliver the resources Beaver Lake Cree require — and deserve — to take on the Tar Sands behemoth.

If this tenacious First Nation can take their treaty rights case to trial, the Nation could set a precedent that forces all projects to be evaluated according to their cumulative impacts on Indigenous rights. But, like the trickster ravens that are our namesake, even in lockdown we’re finding creative ways to mingle, reach out to each other and even, sometimes, to soar. This year has been different in so many ways. We all saw the shrinking of our social worlds, but we also saw the flowering of a mass anti-racism movement that electrified our hope. We moved much of RAVEN’s organizing online, hosting 17 webinars that reached over 3,000 people from New Brunswick to San Francisco! From the nationwide protests in solidarity with Wet’suwet’en to facing the pandemic in isolation and an uprising of unlearning and realizing racial injustices — all amidst the ever growing crisis of climate change — we have all been challenged in one way or another. Please take a moment to read this letter of solidarity with Black Lives Matter penned by member of the Lax Kw’alaams First Nation and our Board President, Jeffrey Nichols. Stay well and stay strong, Kathryn Juricic Development Coordinator, RAVEN Campaign Updates Beaver Lake Cree Nation: The Tar Sands Trial We are incredibly grateful to all the donors who stepped up and raised over $120,000 to support the Beaver Lake Cree’s appeal hearing of the Advanced Cost Order! The Beaver Lake Cree have shown true leadership. You have also shown amazing generosity, meeting our ambitious goal in just one month. We urge you to read Crystal Lameman’s blog post describing her Nation’s decades long Tar Sands Trial. Says Lameman: “We are resilient, and we aren’t going to stop, thanks to the continued support of our allies and supporters. We are very grateful for that.” Over 400 RAVEN supporters joined Crystal and lawyer Karey Brooks, Beaver Lake Cree Nation’s legal counsel for a webinar in late May. Tsilhqot’in Nation victory over Taseko Mines In a massive victorious turn of events, the Supreme Court of Canada denied Taseko Mines leave to appeal the federal rejection of the New Prosperity mine. This means that this mine project is now consigned to the regulatory dust heap. Despite a resounding “No” from the Supreme Court, Taseko Mines unfortunately still has options to pursue mineral exploration in Tsilhqot’in territory. Our Fundraising Campaigns Director, Ana Simeon, explains how, even after this huge win, Tsilhqot''in Nation is still in court. We are so grateful to the Indigenous leaders who stand up for their rights and their land: we are humbled to support such incredible people. Listen to this webinar recording where Chief Jimmy Lulua and Chief Russell Myers Ross of Tsilhqo’tin Nation share stories from their journey to assert their rights and defeat Taseko Mines. Tsleil-Waututh Nation, Coldwater Band, Squamish Nation and the Trans Mountain pipeline As most of us know, the existing Trans Mountain pipeline spilled 150,000 litres of oil in Abbotsford, BC and on the reserve lands of the Sumas First Nation, contaminating their drinking water. This spill reinforces what Nations and allies have been warning all along: we must persevere and stay steadfast in our resolve to see that this pipeline never gets built. The Supreme Court has yet to give or deny leave to appeal for Tsleil-Waututh Nation, Coldwater Band and Squamish Nations. They are contesting the disappointing Federal Court of Appeal judgment on their challenge to Trans Mountain in early February. In a press conference and organizing call right before the February decision, we hosted a lively discussion with Khelsilem (Squamish Nation) as well as Chief Leah George-Wilson and Rueben George (Tsleil Waututh Nation) who were joined by lawyers Eugene Kung and Matthew Kirchner (lawyer for Coldwater Nation). Watch the video to hear what their legal strategy is going forward, how these legal challenges fit in with the bigger vision they have for the Salish Sea and their communities, and how the involvement of this Pull Together community is sustaining and supporting important efforts to uphold justice in the face of the Trans Mountain Pipeline. Wet’suwet’en and the Coastal GasLink pipeline RCMP arrests and removals of land defenders sparked global actions in solidarity with the Wet''suwet''en. Hereditary Chiefs launched legal actions to defend their rights and title from unwanted industrial activity. The legal challenges aim to hold governments of Canada accountable to climate commitments for future generations and to protect Indigenous women and girls from the impacts of industrial man-camps. We raise our hands to the donors who have supported these two legal challenges with donations over $130,000 since the case launched early this year. The first case, launched by all clans of the Wet’suwet’en, seeks a judicial review of Coastal Gas Link’s environmental assessment based on at least 50 permit violations by the company, along with a failure to implement recommendations of the National Inquiry into Missing and Murdered Aboriginal Women and Girls. In the second case, two Wet’suwet’en Houses, through their Hereditary Chiefs, put forward the argument that Canada has a constitutional duty to protect its citizens from climate catastrophe. With this novel approach, Wet’suwet’en Likhts’amishyu (Fireweed) Clan’s case invokes Constitutional provisions about “peace, order and good government” as well as the equality rights of Wet’suwet’en young people and future generations under the Canadian Charter of Rights and Freedoms. The legal challenge argues that Canada’s failure to do its fair share to avert a climate catastrophe would breach the equal protection of the law guaranteed by the Canadian Charter of Rights and Freedoms. We raise our hands to Gapaygy’m Ganauu. May you rest in power. We send our condolences to friends, family and those who knew Richard Wright, land defender of the Gitxan House group Wilp Luutkudziiwus. We acknowledge the tireless efforts Richard has made for Indigenous justice and pay tribute to him here.
